Terms of Service

These Terms of Service govern your access to and use of Allison. Please read them carefully. They include important provisions about billing, acceptable use, disclaimers, and dispute resolution.

1. Acceptance of terms

By creating an account or using Allison, you agree to these Terms of Service. If you do not agree, do not use the service. If you use Allison on behalf of a business, you represent that you are authorized to bind that business to these terms.

2. The service

Allison provides AI-assisted text-message reminders and customer re-engagement tools for small businesses. We may add, change, or remove features over time to improve the service.

3. Eligibility

You must be at least 18 years old and located in the United States to use Allison. The service is currently offered only to U.S.-based businesses messaging U.S. recipients.

4. Acceptable use

You agree not to use Allison to:

  • Send messages to people who have not consented to receive them.
  • Send unlawful, deceptive, harassing, or fraudulent content.
  • Send prohibited content (for example, illegal goods, or content barred by carriers).
  • Ignore opt-out requests or attempt to circumvent STOP handling.
  • Violate the TCPA, CAN-SPAM, carrier rules, or any applicable law.

5. Your responsibilities

You are the sender of record for the messages Allison sends on your behalf. You are responsible for obtaining proper consent from your clients before texting them and for the accuracy of the contact data you upload. You are responsible for keeping your account credentials secure.

6. Intellectual property

Allison and its software, branding, and content are owned by us and protected by intellectual-property laws. You retain ownership of the data you upload. You grant us a limited license to use that data solely to provide the service to you.

7. Billing and trials

Allison starts with a 14-day free trial. After the trial, the service is billed as a recurring monthly subscription until you cancel. You can cancel any time from your dashboard; cancellation stops future charges but does not refund the current period unless required by law.

8. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that message delivery is guaranteed, as delivery depends on carriers and factors outside our control. Allison provides compliance tooling but does not provide legal advice.

9. Limitation of liability

To the maximum extent permitted by law, Allison and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold Allison harmless from claims, damages, and expenses arising out of your use of the service, your content, or your violation of these terms or of any law — including claims arising from messaging recipients without proper consent.

11. Dispute resolution and arbitration

Most concerns can be resolved by contacting support. To the extent permitted by law, any dispute that cannot be resolved informally will be settled by binding arbitration on an individual basis rather than in court, and you and Allison waive the right to a jury trial and to participate in a class action. This section is a draft and must be reviewed by counsel.

12. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

13. Termination

You may stop using Allison at any time. We may suspend or terminate your access if you violate these terms, fail to pay, or use the service in a way that creates legal or carrier risk. Upon termination, your right to use the service ends and we handle your data as described in our Privacy Policy.

14. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you. Continued use of the service after changes take effect means you accept the updated terms.
